New way to prevent recurrent ear infections?

ScienceDaily (Oct. 30, 2012) ? Eliminating bacteria's DNA and boosting antimicrobial proteins that already exist may help prevent middle ear infections from reoccurring. These are the findings from a Nationwide Children's Hospital study that examined how an immune defense protein common in the middle ear interacts with a structure meant to protect a colony of bacteria.

The bacterium nontypeable Haemophilus influenzae (NTHI) causes a wide range of diseases of both the lower and upper airways, including middle ear infection. NTHI, like most other bacteria, can form a biofilm, a robust community of bacteria that allows the bacteria to evade the host's immune system and protects the bacteria from antibiotics and other therapies designed to kill them.

Human beta-defensin-3 is an antimicrobial defense protein expressed in the middle ear of humans and other mammals that kills both Gram-positive and Gram-negative bacteria. Previous research has shown that if expression of beta-defensin is disrupted, the host's ability to control the bacteria in the upper airway is altered and infection worsens.

Investigators in The Research Institute at Nationwide Children's Hospital hypothesized that human beta-defensin-3 might lose its power to kill NTHI if it got caught up within the extracellular DNA that makes up a biofilm's outer layer, thus preventing its contact with bacteria within the biofilm.

"Antimicrobial host defense proteins, like human beta-defensin-3, have been shown to bind to non-host DNA," says Lauren O. Bakaletz, PhD director of the Center for Microbial Pathogenesis "This interaction has an impact on the defense protein's ability to function."

Upon examining their animal model of middle ear infection, Dr. Bakaletz' team found that bacterial DNA and the animal's defense peptides were detected together in biofilms that developed during infection. Also, the defense peptide was predominantly co-localized with the biofilm's extracellular DNA.

When the team exposed the bacteria that cause ear infections to a concentration of human-beta defensin-3 that is typically detected in the a middle ear of a child with active infection, the peptide was able to kill 100 percent of the NTHI, but the killing stopped when extracellular DNA was introduced to the reaction.

"These data support the conclusion that the killing activity of the antimicrobial defense protein was decreased in an NTHI-induced biofilm due to its interaction with eDNA," says Dr. Bakaletz, who is the lead study author and professor of Pediatrics and Otolaryngology at The Ohio State University College of Medicine.

When they removed extracellular DNA from the biofilm, the killing activity of the defense peptide was rescued.

"The ability to restore antimicrobial defense protein activity is encouraging, since biofilms are resistant to most treatments, including traditional antibiotics," says Dr. Bakaletz.

Dr. Bakaletz says this study provides evidence for a new treatment regimen to target biofilms formed by NTHI during middle ear infection. One approach would be to deliver a therapeutic agent that can disrupt bacterial DNA, in conjunction with human beta-defensin-3 to the middle ear of a child with chronic, recurrent infection. Physicians could follow the same pathway used to target the middle ear during ear tube surgery, a common treatment for chronic ear infections.

"This approach would likely bolster the ability of the innate immune system to manage NTHI-induced biofilms, avoiding the need for antibiotics or empowering the use of antibiotics we already have in our arsenal," says Dr. Bakaletz. "Doing so could help diminish the recurrent nature of middle ear infection."

Cybersecurity chief: Attacks on US banks tough to pin down

Cybersecurity getting increased attention from US government after a wave of Internet attacks on US banks. Pentagon blames Iran, but cybersecurity expert Gil Shwed says they could come from any developed country.

Gil Shwed is the co-founder and CEO of?Check Point Software Technologies.?Many recognize him and the company's other co-founder, Marius Nacht, as the world's pioneers in cyber-security. Shwed developed his expertise designing systems for an elite technology unit in the Israel Defense Forces years before the internet became a daily part of our lives.

?Shwed said today "Iran is definitely capable of launching these kinds of attacks but so is just about any other developed country."

?In the last several weeks reports have surfaced that several major American banks have been hit by a wave of Internet-based attacks slowing down or temporarily cutting off service.? Officials at the Pentagon were the first to?point the finger at the government of Iran. Shwed agrees it is possible Iran is to blame but cautions it's very difficult to tell where attacks come from because they can be diverted over and over to cover up the actual source.

?Without admitting guilt, Iranian officials have boasted about their increasing capability to carry out such attacks.

?While the Islamic Republic of Iran is widely blamed, a group calling itself the Izz ad-Din al-Qassam Cyber Fighters Group has claimed responsibility. Their name comes from a Muslim leader that directed waves of murderous attacks targeting Jews living in the Middle East in the 1920s and 1930s.? The Izz ad-Din al-Qassam Cyber Fighters dubbed their internet attacks "Operation Ababil" (Ababil is Farsi for swallow ? the Iranian government also has a fleet of Unmanned Aerial Vehicles by the same name).

?In a statement filed on the internet late Tuesday night the group said, "Operation Ababil is retaliation in response of the organized insulting to the Prophet of Islam done by some arrogant western governments." The statement then again took credit for attacks on several American banks and threatened to carry out more.

On Wednesday, a New York Times report said Iranian hackers were also able to break into the?computer system of oil giant Saudi Aramco?earlier this year and wipe out almost three quarters of the data saved on the company's servers.

?There are signs the U.S. Government is starting to take these threats more seriously. Earlier this month Secretary of Defense Leon Panetta?sounded the alarm?on the nation's cyber-security saying "an aggressor nation or extremist group could gain control of critical switches and derail passenger trains, or trains loaded with lethal chemical. They could contaminate the water supply in major cities, or shut down the power grid across large parts of the country... a cyber-Pearl Harbor that would cause physical destruction and loss of life, paralyze and shock the nation, and create a profound new sense of vulnerability.''

Shwed echoed the Secretary of Defense's comments saying "the risk is absolutely there. But it isn't just government and infrastructure agencies that need to be on guard.? Every individual with a computer is at risk. These organizations, wherever they are, can infect tens of
thousands or even millions of computers."

Shwed added keeping your company or your individual computer or mobile device's security software updated is essential.

Despite the recent wave of cyber-attacks Check Point's stock has taken a hit in the last six months, it's down about 30 percent. Shwed blames the drop in large part to concerns over the European slowdown and the impact that will have on growth. But he optimistically says "the company is doing well whether profits increase 20 percent or decrease 20 percent." He also noted despite the recent downturn, shares are up almost 35 percent over the last three years.

At 8.3mm thick and 1.2 pounds, it's also about as thin and light as any Transformer Pad. Lastly, the VivoTab has NFC -- something you won't find on any of ASUS' older slates.

The VivoTab RT should be available beginning today, starting at $599 for the 32GB tablet with a keyboard dock included. A 64GB tablet-and-dock bundle will retail for $699. Hundreds of Isaac victims show up for legislative Insurance - Nola.com

More than 200 St. John the Baptist Parish residents affected by Hurricane Isaac attended a state legislative Insurance Committee meeting in LaPlace on Wednesday to get answers about insurance concerns. Isaac, which came ashore Aug. 29, caused widespread flooding in St. John and required the emergency evacuation of about? 4,000 residents who were stranded in homes surrounded by rapidly rising water. Parish officials estimate more than 7,000 houses were damaged during the storm.

Members of the Senate and House Insurance Committee held a joint meeting at the St. John the Baptist Parish Community Center to discuss insurance issues related to Isaac and to hear residents' problems and questions.

"Our goal is to try and answer questions and let citizens know that we are there to assist them in their recovery efforts," said Sen. Gary Smith-D Norco, vice chairman of the Senate Insurance Committee.

It was a meeting punctuated by applause from those in the audience as fellow residents shared with the panel of legislators their trials in the post-Isaac landscape. Residents' groans expressed their disagreement or disgust with answers from federal government agencies, such as FEMA representatives.

"I feel very, very frustrated right now," said one woman, who said she has lived in the Cambridge subdivision for more than 30 years and is wondering why there are no grants for home elevations. "Without elevation (rebuilding is) like buying a new pair of shoes and then you go stand in the river. It doesn't make sense to me."

Sen. Troy Brown-D, Assumption said the federal government determines flood zones, which is a primary step in deciding whether an area should be considered for an elevation program. However, Brown said he and other elected officials were pushing to fast-track the construction of a hurricane protection levee for St. John so that elevation wouldn't be needed.

Many residents said they don't understand how insurance companies determined "substantial damage" and the seemingly capricious nature of adjusters in issuing advance checks for property damage to some people while in other cases, withholding money until homeowners provide contract estimates.

Debra Schum said she questioned the logical nature of the National Flood Insurance Program and the FEMA Disaster Assistance Program, two programs meant to help residents in recovery efforts.

Schum said she received an advance from the flood program to start repairs on her house, but the check was made out to her and her mortgage company. The mortgage company wouldn't release the money without having an adjuster's estimate, which wouldn't come for another 30 days, she said.

"Why couldn't the check be made out directly to me?" Schum asked. When FEMA gives disaster assistance the money goes directly to the individual, she said.

Smith, who represents the area and helped schedule the joint session, said the meeting grew out of the many calls and conversations he and other elected officials have had with residents about the insurance process.

Residents were asked to submit their questions and include contact information on cards that were collected by legislative staff members. Smith and other panel members promised the audience that their concerns would be addressed. "If we can't get the issues answered tonight, we will follow up," Smith said.

Touting momentum, Romney tries to look like a winner

CINCINNATI/CHICAGO (Reuters) - He does it too often to be a slip of the tongue.

When Republican presidential candidate Mitt Romney addresses his growing crowds, he always catches himself.

"If I'm president - when, I'm president," Romney says in his speeches now, drawing cheers from the crowd.

Polls suggest Democratic President Barack Obama retains a tenuous hold on the handful of states that will decide the race for the White House, but Romney is casting himself as the man with momentum, rolling toward an inevitable victory on November 6.

Three weeks after Romney's solid performance in his first televised debate against Obama allowed him to chip away at the incumbent's lead in the polls, Romney's strategy appears to boil down to this: to become president, you must act like one.

So Romney, at a brief stop in Cedar Rapids, Iowa, on Wednesday night, said flatly: "We're going to win."

And in Worthington, Ohio, on Thursday, he told supporters: "I want you to know how optimistic I am. This is about to get real good."

Analysts and Republican strategists are praising the tactic, noting that a key element of winning undecided voters is to convince them that they're on a winning team.

"He wants to be seen as the projected winner to get those few undecideds in key states to feel that a vote for Romney is for the next president of the United States," said Larry Berman, a political science professor at Georgia State University.

Obama campaign advisers say that the Romney team is trying to create a false sense of momentum.

They acknowledge the challenger's bounce from the first presidential debate, but say that Obama got the better of the former Massachusetts governor in their other two debates, and say that the electoral numbers favor an Obama victory.

'WE PULLED AN ALL-NIGHTER!'

Obama, whose successful run for the White House in 2008 was cloaked in the slogans "Hope" and "Change," is taking an edgier approach in the final days of this campaign as he tries to show that he has the momentum.

The president is striking an optimistic tone, but he also is blasting Romney as a disingenuous candidate who changes positions to try to fool voters.

Obama aides and outside analysts point to a projected lead in the electoral college, early voting statistics that favor Democrats, and volunteer enthusiasm in the president's massive get-out-the-vote operation as evidence of Obama's momentum.

The president has drawn large crowds during a two-day, eight-state tour that has taken him to Iowa, Colorado, Nevada, Florida, Ohio, Virginia, California and Illinois.

The campaign said that 8,500 people showed up for an early morning rally in Tampa, Florida, on Thursday and about 15,000 were at one in Richmond, Virginia.

"We are right in the middle of our 48-hour, fly-around campaign extravaganza," he said to applause in Florida. "We pulled an all-nighter last night!"

On Thursday, Obama picked up the endorsement of former Secretary of State Colin Powell, a Republican who also endorsed him in 2008, as well as that of The Washington Post, which could help him in the northern Virginia suburbs of Washington, a key area in Obama's push to win politically divided Virginia.

'EVERYONE LIKES A WINNER'

Romney's closing strategy was clear in a fundraising e-mail his campaign sent Thursday morning. The subject line read, "The momentum."

"The debates have supercharged our campaign. We're seeing more and more enthusiasm - and more and more support," Romney said in the e-mail. "This has become more than just a campaign. It's become a national movement. Americans recognize we can do better as a nation than we've done over these last four years."

Republican strategist Rob Johnson, who managed Texas Governor Rick Perry's unsuccessful run for the 2012 Republican presidential nomination, praised the strategy.

"Everyone likes a winner, and (Romney) is showing himself to be just that with his positive vision for America," Johnson said.

Republicans and Romney campaign officials say that opinion polls and bigger crowds are only partial evidence that the race is turning in Romney's favor.

The real proof, they say, is Obama's sharp attacks on the Republican. Romney aides say Obama is acting like a desperate candidate.

"The Obama campaign is slipping," Romney said in Ohio on Thursday, "because they're talking about smaller and smaller things."

A Match Made in Heaven; Experimenting with Fennel and a Simple ...

Now I am normally one to try anything and there is simply nothing I do not eat but fennel was something I was never overly zealous to experiment with at home.

I always imagined that raw fennel had an overpowering taste of aniseed, which gives me horrendous flashbacks to shots of Sambucca from my teenage years? without giving too much insight into my drinking days let?s just say I have had enough of that for a lifetime. I was concerned I would not be able to prepare it in such a way that it wouldn?t smack of underage drinking..

But on a recent visit to my mother?s house we wanted a fresh and interesting salad to have with the most perfect, simple pasta dish, and low and behold her local supermarket had fennel!

This was beautifully fresh, light and a perfect accompaniment to the slightly spicy pasta dish, and I imagine amazing with any meats, and pasta dishes. And it is one of those quick things that doesn?t seem like a recipe; you simply cut combine and enjoy.

Fennell and Pear Salad

  • 1 fennel, trimmed, fronds reserved
  • 2 firm green skinned pears
  • 2 tbspns extra virgin olive oil
  • 1 tbspns lemon juice
  • 100g parmesan or pecorino Romano shaved
  • 2 tbs walnuts, toasted and chopped
  • Salt and Pepper

Slice both the fennel and pear as finely as possible. Keep the pear slices large, but thin, by standing the pear up and slicing from the outside in.

In a bowl, mix the oil, lemon juice and season with salt and pepper. Arrange the slices of pear and fennel on a platter, and shave over parmesan. Drizzle with the oil and lemon mix and garnish with the fennel fronds! Fennel can brown if left to stand for too long so make this as you intend to serve it.

Oh, and what about this pasta you ask..! Well. It embodies everything I love about Italian cuisine. Freshness, flavour, and the mind blowing combination of things that are simply made for each other. My handsome friend Antonio Carluccio when asked what his go to dinner party dish was said this was it. He said it has everything you need in a dish for a party, simplicity, flavour and leaves you with time to spend and relax with your guests. Such a stud.

Chilli, Garlic and Lemon. Again it?s almost embarrassing to give a recipe but I so badly want other people to enjoy this as much as I do, so I am going to. But after you have made it once, you can get the confidence to use more chilli, less garlic, more oil, etc etc and make it exactly like you want it.

My Idea of Heaven Pasta

For 4 or 2? Depending on how much you enjoy it!

  • 400-500g Pasta- any you like, spaghetti, spaghettini, buccatini, any!
  • 150g good quality olive oil
  • 2 chillies, de seeded and finely chopped
  • 4-6 cloves of garlic, finely chopped
  • 1 lemon, juice and zest
  • About 150g or more of freshly grated Parmesan cheese

Now all you need to do is pop your pasta on. A little tip- when the water is boiling add 10g of sea or rock salt. It adds flavour to the pasta and therefore the dish! Cook to your liking.

While the pasta is cooking, heat oil on a medium heat in a large flat frying pan, add the garlic and chillies until oil is hot, around 2 minutes. Add a large pinch of salt, lemon juice and rind stir and take off heat. Add pasta to the oil pan and combine. When combined add around half of the parmesan cheese and serve with remaining parmy and a big crack of pepper!

If this doesn?t blow your mind as much as it often does mine, I will be very surprised.

And get creative with it, you could be fancy and add some cooked prawns, squid or fresh herbs.

Dutch warship destroys pirate 'mother ship'

Somali pirates may not be as active as they once were in the waters off of east Africa, but they still pose a significant danger to anyone who crosses their path. As a group of alleged pirates learned today, however, AK 47s are no match for the power of a NATO warship.

Early Wednesday, the crew of the Dutch warship HNMLS Rotterdam spotted a dhow close to the Somali shoreline. Because these kinds of fishing vessels are often used as "mother ships" for pirate crews, a boarding team was routinely dispatched to inspect the vessel.

As the boarding party neared the dhow (see photo below), the Dutch sailors took sustained gunfire from both the dhow and fighters on shore. The boarding party returned fire and very quickly the dhow ignited in flames and those aboard jumped in the water to escape the blaze. The firefight killed one person aboard the dhow.

The Rotterdam's crew rescued 25 men from the ocean, but the rescue effort proved dangerous as the gunmen on shore continued to fire at both the boarding party and the Rotterdam.

None of the Rotterdam's crew was injured in the incident, though the rigid-hulled boat the boarding party was using sustained damage.

The suspected pirates received medical attention and are now being detained aboard the Rotterdam, which serves as the flagship for NATO's counter-piracy task force off the waters of Somalia, known as "Ocean Shield."

"We know that pirates are increasingly using larger dhows as mother ships. Therefore we routinely inspect them," said Commodore Ben Bekkering, commander of the NATO task force. "In this instance the pirates openly chose confrontation. This does not happen often and it indicates that we are indeed impeding their operations and in doing so, pushing them to take more extreme options."

Somali pirate activity usually decreases during the monsoon period that has just ended, but the drop this year has been especially steep. Only 35 vessels have been attacked so far in 2012 and only five vessels have actually been seized by pirates. In 2010 pirates launched 174 attacks and seized 47 vessels.

The stunning drop in pirate activity is attributed to the continued presence of counter-piracy task forces and the growing use of private security forces aboard commercial vessels.

In addition to the NATO task force, there are two other international naval task forces patrolling the waters off East Africa. One is a U.S. organized force of coalition countries, the other a smaller naval force from European Union member countries. In May, the EU force was given the authority to conduct operations against land-based pirate operations in Somalia.

After today's attack, Commodore Bekkering said, "It is obvious that the scourge of piracy has not gone away and we need to maintain our vigilance."

The danger remains for the 143 merchant sailors still being held for ransom by Somalia's pirates. Some of these sailors have been held for more than two and half years.

In 2000, Milian made her first official musical appearance on Ja Rule's second studio album Rule 3:36, performing guest vocals on his song "Between Me and You". White House ponders a strike over Libya attack

WASHINGTON (AP) ? The White House, under political pressure to respond forcefully to the Sept. 11 attack on the U.S. Consulate in Benghazi, is readying strike forces and drones but first has to find a target.

And if the administration does find a target, officials say it still has to weigh whether the short-term payoff of exacting retribution on al-Qaida is worth the risk that such strikes could elevate the group's profile in the region, alienate governments the U.S. needs to fight the group in the future and do little to slow the growing terror threat in North Africa.

Details on the administration's position and on its search for a possible target were provided by three current and one former administration official, as well as an analyst who was approached by the White House for help. All four spoke on condition of anonymity because they were not authorized to discuss the high-level debates publicly.

In another effort to bolster Libyan security, the Pentagon and State Department have been developing a plan to train and equip a special operations force in Libya, according to a senior defense official.

The efforts show the tension of the White House's need to demonstrate it is responding forcefully to al-Qaida, balanced against its long-term plans to develop relationships and trust with local governments and build a permanent U.S. counterterrorist network in the region.

Vice President Joe Biden pledged in his debate last week with Republican vice presidential nominee Paul Ryan to find those responsible for the Sept. 11 attack on the U.S. Consulate in Benghazi that killed U.S. Ambassador Chris Stevens and three others.

"We will find and bring to justice the men who did this," Biden said in response to a question about whether intelligence failures led to lax security around Stevens and the consulate. Referring back to the raid that killed Osama bin Laden last year, Biden said American counterterror policy should be, "if you do harm to America, we will track you to the gates of hell if need be."

The White House declined to comment on the debate over how best to respond to the Benghazi attack.

The attack has become an issue in the U.S. election season, with Republicans accusing the Obama administration of being slow to label the assault an act of terrorism and slow to strike back at those responsible. Secretary of State Hillary Rodham Clinton said Monday night that the security of State Department operations was her responsibility.

The White House is "aiming for a small pop, a flash in the pan, so as to be able to say, 'Hey, we're doing something about it,'" said retired Air Force Lt. Col. Rudy Attalah, the former Africa counterterrorism director for Defense Department under President George W. Bush.

Attalah noted that in 1998, after the embassy bombing in Nairobi, the Clinton administration fired cruise missiles to take out a pharmaceutical factory in Sudan that may have been producing chemical weapons for al-Qaida.

"It was a way to say, 'Look, we did something,'" he said.

On the subject of developing a special operations unit, U.S. officials received approval from Congress well before the Benghazi attack to reprogram some funding in the budget that could be used for the commando program in Libya. But the details are still being discussed with the Libyans and also must get final approval from Congress, according to the defense official, who spoke on condition of anonymity because he was not authorized to discuss the matter publicly.

The initial cost is estimated at about $6.2 million.

The defense official said U.S. leaders have recognized the need to train Libyan commando forces, but details such as the size, mission and composition of the forces are still being finalized.

A Washington-based analyst with extensive experience in Africa said administration officials have approached him for help in connecting the dots to Mali, whose northern half fell to al-Qaida-linked rebels this spring. They wanted to know if he could suggest potential targets, which he says he was not able to do.

"The civilian side is looking into doing something and is running into a lot of pushback from the military side," the analyst said. "The resistance that is coming from the military side is because the military has both worked in the region and trained in the region. So they are more realistic."

Islamists in the region are preparing for a reaction from the U.S.

"If America hits us, I promise you that we will multiply the Sept. 11 attack by 10," said Oumar Ould Hamaha, a spokesman for the Islamists in northern Mali, while denying that his group or al-Qaida fighters based in Mali played a role in the Benghazi attack.

Finding the militants who overwhelmed a small security force at the consulate isn't going to be easy.

The key suspects are members of the Libyan militia group Ansar al-Shariah. The group has denied responsibility, but eyewitnesses saw Ansar fighters at the consulate, and U.S. intelligence intercepted phone calls after the attack from Ansar fighters to leaders of al-Qaida in the Islamic Maghreb, or AQIM, bragging about it. The affiliate's leaders are known to be mostly in northern Mali, where they have seized a territory as large as Texas following a coup in the country's capital. The Maghreb is a region of northwest Africa that stretches from Libya to Mauritania.

But U.S. investigators have only loosely linked "one or two names" to the attack, and they lack proof that it was planned ahead of time or that the local fighters had any help from the larger al-Qaida affiliate, officials say.

If that proof is found, the White House must decide whether to ask Libyan security forces to arrest the suspects with an eye to extraditing them to the U.S. for trial or to simply target the suspects with U.S. covert action.

U.S. officials say covert action is more likely. The FBI couldn't gain access to the consulate until weeks after the attack, so it is unlikely it will be able to build a strong criminal case. The U.S. is also leery of trusting the arrest and questioning of the suspects to the fledgling Libyan security forces and legal system still building after the overthrow of Moammar Gadhafi in 2011.

The burden of proof for U.S. covert action is far lower, but action by the CIA or special operations forces still requires a body of evidence that shows the suspect either took part in the violence or presents a "continuing and persistent, imminent threat" to U.S. targets, current and former officials said.

"If the people who were targeted were themselves directly complicit in this attack or directly affiliated with a group strongly implicated in the attack, then you can make an argument of imminence of threat," said Robert Grenier, former director of the CIA's Counterterrorism Center.

But if the U.S. acts alone to target them in Africa, "it raises all kinds of sovereignty issues ... and makes people very uncomfortable," said Grenier, who has criticized the CIA's heavy use of drones in Pakistan without that government's support.

Even a strike that happens with permission could prove problematic, especially in Libya or Mali, where al-Qaida supporters are currently based. Both countries have fragile, interim governments that could lose popular support if they are seen allowing the U.S. unfettered access to hunt al-Qaida.

The Libyan government is so wary of the U.S. investigation expanding into unilateral action that it refused requests to arm the drones now being flown over Libya. Libyan officials have complained publicly that they were unaware of how large the U.S. intelligence presence was in Benghazi until a couple of dozen U.S. officials showed up at the airport after the attack, waiting to be evacuated ? roughly twice the number of U.S. staff the Libyans thought were there. A number of those waiting to be evacuated worked for U.S. intelligence, according to two American officials.

In Mali, U.S. officials have urged the government to allow special operations trainers to return, to work with Mali's forces to push al-Qaida out of that country's northern area. AQIM is among the groups that filled the power vacuum after a coup by rebellious Malian forces in March.

U.S. special operations forces trainers left Mali just days after the coup. While such trainers have not been invited to return, the U.S. has expanded its intelligence effort on Mali, focusing satellite and spy flights over the contested northern region to track and map the militant groups vying for control of the territory, officials say.

WASHINGTON -- The U.S. Court of Appeals on Tuesday tossed out the conviction of Osama bin Laden?s former driver for supporting terrorism, saying the law under which he was tried did not apply to his crime.

Salim Ahmed Hamdan was convicted in 2008 by a panel of six U.S. military officers of providing material support to al-Qaida. He was sentenced to five-and-a-half years and released shortly thereafter because he had already spent six years in custody at the Guantanamo Bay Naval Base detention camp in Cuba.


He was the first Guatanamo detainee to be convicted of war crimes.

The Court of Appeals for the District of Columbia vacated Hamdan?s conviction even though he has already served his sentence.

The court noted that Hamdan?s crime occurred from 1996 to 2001 and said the 2006 Military Commissions? Act ?-- which specifically lists material support for terrorism as a war crime triable by military commission? -- cannot be applied retroactively to cover it.

The court also said that while military commissions may try violations of the international ?law of war,? when Hamdan committed the conduct in question the law did not proscribe material support for terrorism as a war crime. ??

?Because we read the Military Commissions Act not to retroactively punish new crimes, and because material support for terrorism was not a pre-existing war crime under 10 U.S.C. ? 821, Hamdan?s conviction for material support for terrorism cannot stand,? the appeals court ruled.

Three years ago University of Tennessee, Knoxville, researchers helped to discover water on the surface of the moon. Now, they are piecing together the origin of that water: solar wind.

A new study confirms solar wind as a source for water embedded in the lunar surface.

Solar wind is the continuous flow of charged particles from the sun. Scientists have speculated it to be responsible for water on the surface of the moon.

Last year Larry Taylor, distinguished professor in the Department of Earth and Planetary Sciences, confirmed comets as the source for water inside the moon. This year, Yang Liu, research assistant professor, and Taylor have confirmed solar wind as the source for water on the outsideby depositing positively charged hydrogen atoms, or protons, onto its surface, allowing it to combine with the moon's oxygen to create water.

"When those protons hit the lunar surface with enough force, they break apart oxygen bonds in soil materials to join together and form water," said Liu. "This does not happen on Earth because our atmosphere and magnetic field protect us from being bombarded by these protons, but the moon lacks this protection."

The researchers used lunar samples from three Apollo missions, including one brought back by Neil Armstrong, analyzing something called an agglutinate. An agglutinate, which resembles "dirty Swiss cheese," is a unique product of space weathering in the lunar regolith, the crushed materials on the moon's surface. The agglutinate was chosen because it consisted of products suspected to contain hydrogen. The researchers used infrared spectroscopy to confirm the presence of hydroxyl (OH). Then they used secondary ion mass spectrometry to obtain the amount of hydroxyl and the origins of the hydrogen.

The researchers discovered that most of the water in the agglutinates came from solar wind. Confirming the solar-wind- induced hydroxyl emphasizes the possibility of finding water on the surface of other similar airless bodies.

"This means water likely exists on Mercury and on the asteroids such as Vesta or Eros further within our solar system," said Liu. "These planetary bodies have very different environments, but all have potential to produce water. The finding also implies solar-wind contributes to water ice in lunar poles."

The research also identifies the largest reservoir for water on the lunar surface since regolith, and thus the corresponding hydroxyl is very widespread. This gives the moon the potential to serve as a habitat and gas station in the sky.

"The hydroxyl in such a volumetrically large reservoir is a valuable resource," said Taylor. "With the cost of $25,000 for taking one pint of water to the moon, water has the potential to be used as rocket fuel as liquid hydrogen or oxygen."
